JWV Demands Immediate Passage of the Military Justice Improvement Act

Washington, DC – The Jewish War Veterans of the USA (JWV) is appalled, embarrassed, and disgusted by the two decisions which came down this week which makes a joke out of the enforcement of sexual abuse complaints in the military by the military itself.

On March 20, Army Brig. Gen. Jeffrey Sinclair was sentenced to an insignificant fine, no pension loss, and no jail time for pleading guilty to adultery and mistreating one of his accusers – all in exchange for evading the truth of a more serious charges. In return, the sexual assault and sodomy charges against him disappeared as did any pretense of his being an officer and a gentleman – which also applies to the judge.

On the same day, a military judge found Midshipman Joshua Tate not guilty of assaulting a female Naval Academy classmate at an off-campus party. The commanders of our military system once again succeeded in maintaining control over imposed discipline and the feigned glory of military service.

Requiring victims of sexual assault to bring their cases through the military justice and its decision making system forces complainants to turn to the self-serving chain of command to ask for justice. If the perpetrator is someone above them, coming forward in search of justice may seem impossible.

Senator Gillibrand’s Military Justice Improvement Act would take crimes like sexual assault outside of the military justice system and would initially ensure victims a better opportunity to seek equal justice and protection under the law. It is well past time for this reform to become law.

Volunteers going into the military don’t expect, and must not, be treated as second class citizens when they decide to serve our country. Gender relationships require equality in performance and in reality.
